Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of ealana, an applicant tracking system and recruitment platform operated by Ealana Platforms Private Limited ("ealana," "we," "us," or "our").
By accessing or using ealana, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.
We may update these Terms and will post the revised date. Where required, we will provide additional notice before a material change takes effect. Continued use after the effective date means you accept the revised Terms.
User Accounts and Roles
Account Types
ealana offers different account types:
Account Registration
To use ealana, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
Candidate Privacy Requests
Candidate privacy requests are handled as described in our Privacy Policy. Removing someone from a recruiter’s talent pool removes only that organization-scoped membership; it is not a global erasure or global opt-out.
Withdrawing an application, leaving an organization pool, withdrawing from future global matching, and requesting erasure review are different actions. Global matching and erasure requests require verified candidate authority or an authorized privacy process.
Account Termination
We may suspend or terminate an account to address a material violation of these Terms, fraud, a security or legal risk, or harm to users or the service. Where practicable and lawful, we will provide notice or a way to contact us about the action.
Acceptable Use
You agree to use ealana only for lawful purposes. You may not:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Submit false, misleading, or fraudulent information
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems
- Scrape, harvest, or collect user data without permission
- Harass, abuse, or harm other users
- Use automated systems to access our services without authorization
- Reverse engineer or decompile our platform
- Resell or redistribute our services without authorization
Content and Intellectual Property
Your Content
You retain ownership of content you submit to ealana (resumes, applications, job postings, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content for the purpose of providing our services.
Our Content
ealana's platform, design, features, and functionality are owned by Ealana Platforms Private Limited and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.
AI-Generated Content
AI-generated fit scores, recommendations, and analysis are provided for informational purposes only. We do not guarantee their accuracy and they should not be the sole basis for hiring decisions.
Job Postings and Applications
For Recruiters
- Job postings must be accurate and comply with employment laws
- You may not post discriminatory job listings
- You are responsible for reviewing applications and making hiring decisions
- You must have appropriate authority to submit, access, and use candidate data
- You must handle candidate data in compliance with applicable privacy requirements
- You must honor candidate restrictions and may not re-import or recreate a suppressed profile to bypass them
- Your organization-scoped access does not authorize global deletion or access to another organization's recruitment history
- You may not use ealana for unlawful recruitment practices
For Candidates
- Applications must contain truthful and accurate information
- You may not submit fraudulent credentials or resumes
- You understand that applying does not guarantee employment
- Submitting an application makes its materials available to the organization handling that application
- An application does not by itself authorize unrelated organizations to view that organization's private workflow history
Payment and Subscriptions
Where ealana offers paid features or subscription plans and you complete a purchase:
- Fees are non-refundable except as required by law
- Paid access lasts for the billing term you purchase at checkout
- We may change pricing with advance notice
- You are responsible for completing payment for any future billing term you purchase
Disclaimers and Limitations
No Warranty
ealana is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure.
Limitation of Liability
To the maximum extent permitted by law, Ealana Platforms Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ealana.
Third-Party Services
ealana uses third-party cloud, communications, payment, monitoring, and AI infrastructure providers. Their availability and independently operated services may be subject to their own terms and policies.
Indemnification
You agree to indemnify and hold harmless Ealana Platforms Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your violation of these Terms
- Your violation of any law or regulation
- Your infringement of third-party rights
- Your unlawful use of ealana or material breach of these Terms
Governing Law and Disputes
These Terms are governed by the laws of India. Disputes will be handled through the courts, tribunals, grievance channels, or another process available under applicable law. We may agree in writing to arbitration where it is lawful and appropriate.
Nothing in these Terms limits a right, remedy, or forum that cannot lawfully be waived.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
